Frequently Asked Criminal Law Questions

1. Do I have to answer police questions?


Generally, you do not have to answer police questions however there important exceptions to this rules.
As a matter of common sense, if you are asked questions by police about a simple matter of which you are innocent, it is probably a good idea to answer their questions. In other situations, speak to one of our Criminal Lawyers first.


Platinum Criminal Lawyers Sydney strongly advise that, if the police want to record an interview with you on tape or video, always ask to speak to a criminal lawyer first.


The exceptions to the general rule regarding not having to answer police questions are:


• A police officer can request a person to provide his or her name and address if those details are unknown to the police officer and if the police officer believes on reasonable grounds that the person may be able to assist in the investigation of an alleged offence because the person was at or near the place where an alleged indictable offence occurred around the time when the offence occurred.


• Where a police officer reasonably suspects that a motor vehicle was or may have been used in the commission of an indictable offence, the police officer can ask the owner, driver or passenger of the vehicle to supply details of the driver and passengers in the vehicle at the time of the offence.
 

2. When do the police have the right to arrest to me?

If a police officer has reasonable grounds to suspect that you have committed or are in the process of committing a criminal act.

A police officer does not have a right to arrest you to collect further evidence or to investigate whether you committed an offence. In such circumstances the arrest may be illegal.

3. If I am arrested how long can I be held in custody?

Generally the police must either charge you with an offence or let you go. The police have a four (4) hour investigation period in which they can hold you without charge. However, this four hour investigative period may be extended under certain circumstances.

However, if you are charged the police will make a decision whether to grant you bail. Should the police officer refuse bail, you will remain in custody till a bail application is heard by the court.
 

4. Should I consent to an interview with the police?

Platinum Criminal Lawyers Sydney strongly advise that under no circumstances should you consent to an interview without speaking to an experienced criminal lawyer first.

Generally, clients are advised to exercise their right to silence, however, from time to time if our experienced Criminal Lawyers deem it appropriate there may be situations in which a record of interview may be beneficial. This is only a decision that an experienced Criminal Lawyer can make.

The consequences of consenting to an interview when it is not advisable can be catastrophic. For instance you may give the police evidence which they would have never obtained otherwise; this evidence may then be used against you at trial.

5. What can a criminal lawyer do for me at the police station?

An experienced criminal lawyer will provide you with reliable and competent advice to ensure your best interests are protected. The presence of an experienced criminal lawyer is incredibly comforting, especially if it is the first time that you are arrested and detained by police. At times, a criminal lawyer can make submissions to the police regarding bail.

1. When you Plead 'Guilty' in the Local Court
All work up to and including a full day in court:
Courts in Sydney City and Metropolitan Area: $1,100.00 + GST
Courts in Other NSW Cities (Gosford, Newcastle, Wollongong etc): $1400 + GST
Courts in NSW Country Areas: $2000 + GST
 

Most Local Court 'guilty pleas' can be completed in one day. However, in certain situations an additional day in court is required, for instance:
• You may need time to complete a traffic offenders program
• The court may order a pre-sentence report which may take time to prepare
 

For each additional appearance we will charge:
• $600 + GST for Sydney City and Metropolitan courts
• $700+ GST for Other NSW Cities (Gosford, Newcastle, Wollongong etc).
• $1200+GST for NSW Country Areas.
 

2. Attending Police Station
Sydney City and Metropolitan Area: $900 + GST
Outside Sydney Metropolitan Area: $900 + GST
 

3. Attending Prison for Conference
Sydney Metropolitan Area (eg Silverwater MRRC, Parklea, Long Bay, Surry Hills Cells): $800 + GST
Outside Sydney Metropolitan Area: $100 + GST
 

4. Bail Application in the Local Court
All work up to and including a full day in court:
Courts in Sydney City and Metropolitan Area: $800 + GST
Courts in Other NSW Cities (Gosford, Newcastle, Wollongong etc): $1000 + GST
Courts in NSW Country Areas: $2000 + GST
 

5. Bail Application in the Supreme Court
All work up to and including a full day in court:
$1800.00 + GST
 

6. Appeal to District Court
All work up to and including a full day in court:
Courts in Sydney City and Metropolitan Area: $1500 + GST
Courts in Other NSW Cities (Gosford, Newcastle, Wollongong etc): $1700 + GST
Courts in NSW Country Areas: $2000 + GST
 

7. Driver Licence Appeals (against Infringement Notice or Suspension Notice)
All work up to and including a full day in court
Sydney City and Metropolitan Area: $1200 + GST
